"Guesthouse Tessen" Terms of Use and Accommodation Contract

Scope of Application

Article 1. Accommodation contracts concluded between "Guesthouse Tessen" (hereinafter "the Guesthouse") and its guests, and any related contracts, shall be governed by these Terms. Any matters not provided for in these Terms shall be governed by applicable laws and generally established practice.

2. Where the Guesthouse agrees to a special arrangement that does not conflict with applicable laws or practice, that special arrangement shall take precedence over the preceding paragraph.

Application for Accommodation Contracts

Article 2. A person wishing to apply for an accommodation contract with the Guesthouse shall provide the Guesthouse with the following information:

1. Name of the guest(s)
2. Dates of stay (including the estimated arrival time if checking in outside front-desk hours)
3. Phone number and a reachable e-mail address
4. Number of guests
5. Any other information the Guesthouse considers necessary

2. If a guest requests to extend their stay beyond the dates stated in item 2 of the preceding paragraph while already staying, the Guesthouse will treat the request, at the time it is made, as a new application for an accommodation contract.

3. Guests under the age of 18 (including high school students) traveling without an adult will be refused accommodation unless parental/guardian permission has been obtained. A signed consent form from a parent or guardian is required for every guest in the group. Junior high and elementary school students may be accommodated if accompanied by a responsible person aged 20 or older (other than a family member) and a parental/guardian consent form is submitted.

Formation of Accommodation Contracts

Article 3. An accommodation contract is formed when the Guesthouse accepts an application as described in the preceding Article. This does not apply where the Guesthouse can show that it did not accept the application.

2. Once an accommodation contract for one or more nights has been formed under the preceding paragraph, the guest shall pay the basic accommodation charge for the full length of stay in full by the time of check-in.

Refusal to Conclude Accommodation Contracts

Article 4. The Guesthouse may decline to conclude an accommodation contract in any of the following cases:

2. The application for accommodation does not comply with these Terms.

3. No rooms are available due to full occupancy.

4. The applicant is found likely to engage in conduct, in connection with the stay, that violates applicable law or public order and morals.

5. The applicant is found to fall under any of the following:

1. A member of an organized crime group as defined in Article 2, Item 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991) (hereinafter "organized crime group"), a member of such a group as defined in Article 2, Item 6 of the same Act (hereinafter "organized crime group member"), an associate member, or any other person otherwise associated with organized crime or antisocial forces
2. A corporation or other organization whose business activities are controlled by an organized crime group or its members
3. A corporation any of whose officers is an organized crime group member

6. The applicant has made violent or unreasonable demands of the Guesthouse or its staff, or has demanded a burden exceeding a reasonable scope.

7. The applicant is clearly found to be infected with an infectious disease designated as Category I to III under the applicable Ministry of Health, Labour and Welfare ordinance.

8. Accommodation cannot be provided due to a natural disaster, facility malfunction, or other unavoidable circumstances.

9. The applicant is found likely, due to extreme intoxication or other conduct, to cause significant inconvenience to other guests.

Cancellation by the Guest

Article 5. A guest may cancel an accommodation contract by notifying the Guesthouse.

2. Where a guest cancels all or part of an accommodation contract for a reason attributable to the guest, the Guesthouse will charge a cancellation fee as follows:

1. Cancelled 7 to 4 days before the stay — 20% of the accommodation charge
2. Cancelled 3 to 2 days before the stay — 50% of the accommodation charge
3. Cancelled 1 day before the stay — 80% of the accommodation charge
4. Cancelled on the day of the stay — 100% of the accommodation charge
5. No-show without notice — 100% of the accommodation charge

3. If a guest, without notifying the Guesthouse, has not arrived by 20:00 on the date of the stay (or, if an arrival time has been specified in advance, within two hours after that time), the Guesthouse may treat the accommodation contract as having been cancelled by the guest.

Cancellation by the Guesthouse

Article 6. The Guesthouse may cancel an accommodation contract in any of the following cases:

2. The guest is found likely to engage in, or is found to have engaged in, conduct in connection with the stay that violates applicable law or public order and morals.

3. The guest is clearly found to be infected with an infectious disease designated as Category I to III under the applicable Ministry of Health, Labour and Welfare ordinance.

4. Accommodation cannot be provided due to a natural disaster or other event of force majeure.

5. The guest is found to fall under any of the following:

1. Being a member of an organized crime group, an organized crime group member, an associate member, or otherwise associated with organized crime or antisocial forces
2. Being a corporation or other organization whose business activities are controlled by an organized crime group or its members
3. Being a corporation any of whose officers is an organized crime group member

6. The guest has made violent demands of the Guesthouse or its staff, or has demanded a burden exceeding a reasonable scope.

7. The guest is found likely, through noise, intoxication, or other conduct, to cause inconvenience to other guests, or has engaged in conduct causing significant inconvenience to other guests.

8. The guest has smoked in a designated non-smoking area, tampered with fire-fighting equipment, or otherwise engaged in conduct that impedes fire prevention.

9. The guest, whether temporarily or otherwise, has allowed a person other than a party to the accommodation contract to enter the guest room.

10. The guest has brought, or attempted to bring, any of the following onto the premises:

1. Firearms or bladed weapons
2. Items emitting an extremely offensive odor
3. Items in extremely large quantities
4. Flammable or combustible substances (such as gunpowder or volatile oil)
5. Plants, animals, insects, or similar items
6. Any other item whose possession is prohibited by law

11. The guest has removed the Guesthouse's fixtures or property from the premises, or moved them to another location within the premises.

12. The guest has attempted to alter, remodel, or modify the building or its facilities.

13. The guest has distributed advertising material or goods, engaged in religious activity (proselytizing or solicitation), or conducted business activities directed at other guests, visitors, or staff on the premises.

14. The guest has engaged in conduct causing significant inconvenience to other guests.

15. The guest has otherwise failed to comply with the Guesthouse's Terms of Use.

Article 7. Where the Guesthouse cancels an accommodation contract pursuant to the preceding Article, the Guesthouse will not charge the guest for any accommodation services not yet provided.

Registration of Guests

Article 8. On the date of stay, guests shall register the following information at the Guesthouse's front desk:

1. The guest's name, age, sex, address, and occupation
2. For foreign nationals, nationality and passport number
3. Departure date and estimated departure time
4. Any other information the Guesthouse considers necessary

2. Where a guest intends to pay the charges referred to in Article 12 by a means that may substitute for currency, such as an accommodation voucher or credit card, the guest shall present the relevant means at the time of registration referred to in the preceding paragraph.

3. Once the Guesthouse has provided a room to a guest and made it available for use, the accommodation charge will be payable even if the guest chooses not to stay.

Use of Guest Rooms

Article 9. Guests may use their guest room from 15:00 until 10:00 the following morning. However, for consecutive nights of stay, the room may be used all day except on the arrival and departure dates.

2. Notwithstanding the preceding paragraph, the Guesthouse may permit use of the room outside the stated hours, in which case an additional charge will apply.

3. If, after a guest has checked out, baggage or belongings are found left behind in the guest room or elsewhere on the premises, the Guesthouse will take such measures as it considers appropriate in accordance with applicable law. Where the owner of such baggage or belongings can be clearly identified, the Guesthouse may, at its discretion, contact the owner and request instructions, although it is under no obligation to do so.

4. Where it is clear that a guest, after checking out, has continued to use a common area or other part of the premises other than a guest room for a length of time equivalent to an additional stay, the Guesthouse may charge an appropriate fee.

Compliance with the Terms of Use

Article 10. Guests shall comply with the Guesthouse's Terms of Use.

Business Hours

Article 11. The main facilities of the Guesthouse operate during the following hours; detailed hours for other facilities will be posted on-site.

1. Front desk — 15:00 to 20:00
2. Common areas — 15:00 to 22:00 (only while other guests are present)
3. Bath / shower — 24 hours

2. Kitchen — 15:00 to 22:00 (only while other guests are present)

3. The hours set out in the preceding paragraph may be temporarily changed where unavoidably necessary, in which case notice will be given by an appropriate method.

Payment of Charges

Article 12. The breakdown of the accommodation charges payable by the guest, and the method of calculating them, are as follows:

"Total amount payable = Basic accommodation charge (room rate) + Tax (consumption tax)"

2. Charges shall be paid in cash, by credit card, or by another method accepted by the Guesthouse, either upon the guest's arrival or when requested by the Guesthouse.

3. Once the Guesthouse has provided a room to a guest and made it available for use, the full accommodation charge for the day will be payable even if the guest chooses not to stay, or voluntarily discontinues the stay after using the room.

4. If a key that permits entry to the Guesthouse is not returned after check-out, a charge equivalent to half a day's accommodation will apply once four hours have passed since the check-out time, and a full day's accommodation charge will apply if the key has not been returned by 18:00. This does not constitute a guarantee of accommodation for the day in question.

Responsibility of the Guesthouse

Article 13. Where the Guesthouse causes damage to a guest in the course of performing, or failing to perform, an accommodation contract or any related contract, the Guesthouse will compensate the guest for that damage. This does not apply where the damage is not attributable to a cause for which the Guesthouse is responsible.

2. The Guesthouse bears no responsibility for any accident arising from a guest's failure to comply with the Guesthouse's Terms of Use.

When the Contracted Room Cannot Be Provided

Article 14. Where the Guesthouse is unable to provide a guest with the contracted room, the Guesthouse will, with the guest's consent, arrange alternative accommodation under conditions as close as possible to those originally agreed.

2. Notwithstanding the preceding paragraph, where the Guesthouse is unable to arrange alternative accommodation, it will pay the guest compensation equivalent to the cancellation fee, which will be applied against any damages owed. However, no compensation will be paid where the Guesthouse is not responsible for its inability to provide the room.

Handling of Deposited Property

Article 15. Guests are responsible for managing their own cash and other valuables. The Guesthouse bears no responsibility whatsoever for any loss or damage to such items.

Custody of Guests' Baggage or Belongings

Article 16. Where a guest's baggage arrives at the Guesthouse ahead of the guest's stay, the Guesthouse will keep it in safe custody only where it has agreed in advance to receive it, and will hand it to the guest at check-in or place it in the guest's room. However, the Guesthouse will not accept valuables for safekeeping.

Responsibility of the Guest

Article 17. Where the Guesthouse suffers damage due to a guest's intentional act or negligence, that guest shall compensate the Guesthouse for the damage.

Disclaimer

Article 18. Use of computer/internet communications from within the Guesthouse is at the guest's own responsibility. The Guesthouse bears no responsibility whatsoever for any damage suffered by a user as a result of a service interruption caused by a system failure or any other reason during use of such communications. In addition, where the Guesthouse's use of computer/internet communications is found by the Guesthouse to be inappropriate and causes damage to the Guesthouse or a third party, the responsible party shall compensate for that damage.

Amendment of these Terms

Article 19. Where a matter is not provided for in these Terms, or where the Guesthouse determines it necessary for the conduct of its business, the Guesthouse may change the contents of these Terms without prior notice.

Supplementary Provisions

These Accommodation Contract Terms apply from October 1, 2021 (hereinafter the "Effective Date"). However, accommodation contracts already formed before the day preceding the Effective Date shall be governed by the previous Accommodation Contract Terms and Terms of Use.
